Terms of Use: Bonsai Manager

Welcome to Bonsai Manager. By using our application and the website bonsaiapp.com.br, you agree to the terms described below. We recommend careful reading.
1. Purpose and Features
Bonsai Manager is a cultivation support tool designed for recording collections, species catalogs, styles, maintenance history (pruning, fertilizing, repotting, etc.), and scheduling personalized or automatic alerts.
User Content: The user is solely responsible for the data entered, including photos, schedules, and technical descriptions.
Educational and Informational Nature: The app provides organization tools and reminders, but does not replace technical judgment, direct observation, and the cultivator's experience.
2. Registration and Security
To access cloud saving and data synchronization features, the user must create an account.
You agree to provide truthful information, including a valid and active email address.
Safeguarding your password is entirely your responsibility. Bonsai Manager is not liable for unauthorized access resulting from the user's negligence with their credentials.
3. Subscription Plans, Billing, and Cancellation
Bonsai Manager offers free basic features and advanced features exclusive to subscribers ("Premium Plans").
Modalities: The user may choose between two subscription modalities:
- Monthly Plan: Recurring charge every month.
- Annual Plan: Recurring charge every twelve months, at a promotional rate proportionally lower than the monthly plan.
Cancellation and Recurrence: The subscription may be canceled by the user at any time through the app download platform (Google Play Store / Apple App Store) or account settings. Cancellation stops automatic renewal (recurrence) for the following period.
Refund Policy: Upon cancellation, the amount already paid for the current period (month or year in progress) will not be returned or refunded, whether in full or proportionally.
Access after Cancellation: After requesting cancellation, the user will continue to have unrestricted access to paid features until the exact end of the period already paid. After that period, access to exclusive tools will stop and no new charges will be made.
4. Alert Registration and Notifications (Push and Email)
The application has a notification system to support the bonsai care routine.
User Alerts: The user may schedule personalized alerts (date and time) to remember to perform specific actions. The application will send a push notification to the mobile device and an email to the registered address.
App Alerts: Bonsai Manager may generate and send automatic notifications (push and email) with suggestions, tips, or generic reminders based on cultivation context and the user's interest.
Technical Requirement: To receive push notifications, it is mandatory that the user expressly authorize notifications in the operating system settings of their own mobile device. Bonsai Manager is not responsible for missed alerts due to manual deactivation, lack of internet connection, email spam filters, or technical failures of the device's operating system.
5. Intellectual Property and License of Use
Of the Application: All code, design, interface, logos, and content created by the system are the exclusive property of Bonsai Manager. We grant you a personal, revocable, non-transferable, and non-exclusive license to use the service.
Of Your Photos: When uploading photos of your bonsais, you retain copyright, but grant Bonsai Manager a free, sublicensable, worldwide license to store, display, and process those images exclusively for the strict operation and provision of the service to you.
6. Limitation of Liability (Safeguard Clause)
Biological Risks: Bonsai Manager is strictly a support and logging tool. We are not responsible for the health, integrity, illness, or eventual death of any plant, regardless of whether the user followed schedules they entered or alerts/suggestions issued by the application. Cultivating living beings depends on numerous biological, climatic, and environmental variables that are entirely outside the software's control.
Availability: We strive to keep the service online 24 hours a day, 7 days a week, but we do not guarantee that the application will be permanently free of interruptions, delays in sending emails/notifications, or technical errors.
7. Storage and Data Loss
Although we perform regular cloud backups, the user is encouraged to keep copies or external records of critical collection information.
In the event of account termination by the user or prolonged non-payment after the plan ends, data may be permanently deleted from our servers, as detailed in the Privacy Policy.
8. Prohibited Conduct
The user may not:
- Use the app to store images that violate third-party rights, others' intellectual property, or local laws.
- Attempt reverse engineering, decompilation, or modification of the application.
- Use automated scripts, bots, or scraping tools to extract data from the website or the app.
9. Changes to the Terms
We reserve the right to update these terms periodically to reflect app improvements or legal changes. Significant changes that directly impact financial or privacy conditions will be notified through the registered email or highlighted notices on the application dashboard.
10. Jurisdiction
To resolve any disputes arising from this document, the courts of the district of Belo Horizonte/MG are elected, with express waiver of any other, however privileged it may be.
